Directive (EU) 2019/2161 added Article 6a to the Price Indication Directive. Member States were to apply the transposing measures from 28 May 2022.
For an announcement of a price reduction, Article 6a defines the prior price as the lowest price applied by the same trader during a period of at least 30 days before the reduction.
The legal classification of an announcement, national rules and permitted treatment for perishable goods, new arrivals or progressive reductions require market-specific review.
Technical interpretation
Separate price events from the current displayed value. Record product or variation, channel, market, customer context, currency, effective time and source so the applicable history can be reconstructed.
Define how scheduled sales, catalogue rules, coupons, personalised offers, tax display, feeds and caches affect the displayed claim before choosing a calculation path.
Test missing history, overlapping campaigns, returns to regular price, channel-specific prices and delayed feed or cache updates as explicit failure cases.
